TERMS AND CONDITIONS

Agreement Between Parties

ThePhotoFairy (hereafter referred to as TPF) and you, “the client,” agree that the following services will be provided by TPF until any updated terms and conditions are agreed upon and confirmed in writing by all involved parties.

02 Payment Terms

Payment must be made directly to TPF within 14 days of receiving a valid tax invoice. All invoices must be settled before the return of the client's original media. TPF reserves the right to withhold the return of media until full payment of any outstanding invoices is received.

03 Cancellation Policy

If a cancellation is made after work has commenced, the client will be charged:

100% of the cost of completed work, plus
A $20 cancellation fee
The total cancellation fee will not exceed the original order price.

04 Disclaimer

a. The client releases TPF and its agents from any liability, risks, or complications arising from the services provided.
b. By submitting prints or documents to TPF, the client acknowledges that their value does not exceed the cost of scanning an equivalent quantity of photographs. Other than this agreed value, TPF is not liable for any direct, consequential, or incidental loss or damage resulting from the use of our services.

05 Indemnity

a. TPF will perform all services with due care and professionalism.
b. However, while we strive for accuracy, TPF and its agents do not provide warranties or guarantees that our services, products, or any third-party information are completely free from errors or omissions.

06 Confidentiality & Privacy Agreement

TPF will never sell, distribute, copy, or use any client information or media without prior written consent. All media and information provided remain strictly confidential during the contract period.

07 Intellectual Property Rights

All materials, written content, audio, and visual media produced by TPF remain the exclusive property of TPF.

This agreement does not grant any rights, titles, or licenses for the client to use, sell, copy, exploit, or further develop any content created by TPF.
